Traffic accident compensation: €900K in First Instance, €340K in the Court of Appeal
The Court of Appeals awarded € 100,000 compensation to each of the victim's parents, each of his two brothers with € 60,000, and his grandfather with € 20,000. Interest from the day of the first instance decision should be added to the above amounts. This interest is calculated at 5.25% for legal interest and 7.25% for default interest; for this amount the annual interest amounts to € 42,600. The Court of Appeal also awarded legal costs to the detriment of the Municipality and the insurance company in the amount of € 7,650.
The first instance decision was set at € 900,000. The insurance company had filed an appeal of complicity as the driver of the motorcycle was not wearing a helmet. But the court found that this omission was not linked causally to the effect because the cause of death was the fatal injury of the neck, and not the head which would have been protected by a helmet.
In such a case, forensic /medical experts are crucial in the final decision because they must clearly prove the root cause of death (in this case the decisive injury to the neck) since such an accident certainly causes head injury.
