Traffic Accidents in Greece with Uninsured, Stolen or Hit & Run drivers.

If the person at fault for the accident informs you that they are not insured to drive the vehicle involved but which is insured for someone else to drive, that insurance company may still be willing to deal with claims for injury compensation from an innocent party even though they do not insure the driver. This decision will be down to the discretion of the insurance company involved. If they are not willing to deal with it or if there is no insurance policy in force for the vehicle at all, the only course of action would be to make a claim through the Insurance Guarantee Fund of Liability from Car Accidents (www.epikef.gr).

In 2013 there were 3.395 requests made for uninsured vehicles while for 2014 they are estimated 2.800 requests to be made. It is estimated that in Greece there are 700.000 uninsured vehicles among which 250.000 are private cars, 320.000 motor cycles, 150.000 trucks και 1800 taxis.

The accident must have occurred however on a public road or area to which the public and their vehicles have open and unfettered access. There is a legal obligation for everyone to have insurance for their vehicles if driven on public roads. There is however no obligation to have insurance for vehicles on private roads or places. Employers must have employer's liability insurance for employees driving vehicles on their premises but there is no corresponding duty to have public liability or other insurance to cover other vehicle accidents involving members of the public or third parties on the employer's private land.

If the driver responsible for the road traffic accident has stolen the vehicle involved in the accident and is identified by the Police then any insurance policy taken out by the owner of the vehicle may compensate innocent victims of injury. This decision will be down to the discretion of the insurance company involved. If they are not willing to deal with it or if there is no insurance policy in force for the vehicle at all, the only course of action would be to make a claim through the Insurance Guarantee Fund of Liability from Car Accidents.

In 2013 in Greece 28.801 vehicles were stolen and some of them were involved in car accidents. In the same year, 874 people died due to car accidents while 14.812 were injured.

In the case of hit and run, if the Police manage to trace the driver responsible for your accident and they have a valid insurance policy in force then your personal injury compensation claim can be made as normal to the insurance company. If the Police manage to trace the driver responsible for your injury and they do not have a valid insurance policy in force, you could make a claim via the Insurance Guarantee Fund of Liability from Car Accidents through the Uninsured Driver Scheme. If the Police do not manage to trace the driver responsible for your accident at all then your only option may be to approach the Insurance Guarantee Fund of Liability from Car Accidents to see if they can help you.

Insurance companies, in their effort to minimize the compensation you deserve may try various ways of approaching you through "very friendly" intermediaries like lawyers, claim managers or social workers.

Our specialist will examine and propose without any commitment from your side how to support you best to maximize your satisfaction.
