Taxi driver co-responsible for clients getting off safely
As stated in the judgment, when the client got off the taxi, the driver, instead of driving with caution so as to ensure her safe transportation, hastily and abruptly drove away, before her getting off completely and having a safe distance from the taxi. That had as a result that the right back door caught a string of her jacket and pulled her for a distance of five metres along the road. She was hospitalized with injuries and fracture of her left shoulder at the hospital "Agios Andreas" in Patras and underwent surgery.
The Supreme Court judges, as the judges of the Court of Appeal, in contrast with the Primary Court which considered the passenger as sole responsible for the accident, agreed that the accident was mainly due to the negligence of the driver, who was obliged to wait for the passenger to get off and then move. They believed, however, that she was also repsonsible for the accident, since she closed the door of the car and attempted to depart, without ensuring that the string of her jacket did not remain in the taxi.
With this favourable verdict she was awarded a compensation of 10,000 euro for moral damages and 9,500 euros for hospitalization expenses and for a housekeeper who she hired for six months because she was were unable to take care of herself, but also for the destruction of her leather coat and pants.
It was ruled that the Court of Appeals wrongly rejected two requests for compensation related to amount of 8,500 euros for use of housekeeper for two years and 9,000 euros for distruction of t-shirt, glasses, shoes, bag, diamond earrings, cross and gold watch.
