What is an industrial accident
An occupational accident is one that occurs to a worker during or on the occasion of work and which is caused by a sudden event, a violent event, as long as it caused the worker to be unable to work for more than 4 days or even loss of life. A violent event means that there is an exceptional and sudden effect of an external factor unrelated to the worker's organic condition. This influence may be caused by the aggravation of working conditions under unforeseen and exceptional circumstances. Therefore, a pre-existing illness which manifests itself or is aggravated during the performance of work under normal conditions does not constitute an accident at work. However, if the illness arose during the performance of the work under exceptional and unusual circumstances or as a result of excessive effort made by the worker in the performance of his work, it is classified as an accident at work.
Case law has held that an employee's excessive effort that caused death or incapacity for work is an industrial accident.
Thus, acute myocardial infarction caused by unusual working conditions and adverse conditions has been held by the Courts to constitute an industrial accident.

During the execution of the work
Those that occur during the performance of the work as a direct consequence of the work (injury to the worker by machinery, fall during the performance of the work, etc.).
On the occasion of the work
Those that occur on the occasion of work, i.e. outside the place and time of work, provided that they are even indirectly related to work. It has been held by the Courts that those occurring while going to work, or while performing an act in the interest of the employer, even without his order, or during the midday break at the place of work on arrival or departure and for a period of one hour respectively, also constitute accidents at work.

Those due to occupational disease. Occupational diseases are those caused by the effects of working conditions, as detailed in the IKA Sickness Regulations. More broadly, however, any aggravation of a pre-existing illness that occurred as a result of continuing the same work also constitutes an occupational accident.
