What is a work accident.
According to Greek law an accident that happens to the employee during the work or in relation to the work and which is due to an abrupt or violent event, as long as this has had as a result on the employee's inability to work for over 4 days or even loss of life. Violent event means that there is an extraordinary and sudden external impact factor that has nothing to do with the health status of the employee. This impact can be the result of burdening of the working conditions under unforeseen and exceptional circumstances. Therefore pre-existing illness, which appears or worsens during the execution of work under normal circumstances is not an accident. But if the illness came while performing the work under exceptional and unusual conditions or excessive effort made by the employee in the performance of his work, then this is classified as an accident.
The Court has judged that excessive effort by the employee which caused death or incapacity for work is a work accident.
Thus, acute myocardial infarction, caused by unusual working conditions and adverse conditions has been deemed by the courts to be an accident.
Also as work accident is defined what was caused due to overly demanding working tasks assigned to an employee who has not completely recovered from an illness.
The related provisions on work accidents cover three types of accidents:
During the performance of work
Those that occur during the performance of work as a direct consequence of this (the worker's injury by machine, fall during the execution of work etc.).
In relation to work
Those that occur in relation to work which means outside the place and the time of work, assuming that they are even indirectly connected with the work. The courts have also judged as work accidents those occurring during the transport to and from work or caused due to actions undertaken in the interests of the employer, even without his mandate, during break time at the place of work or when coming or leaving and for a period of one additional hour respectively.
Those due to an occupational disease
Occupational diseases are those due to the effects of working conditions, as referred in details in the occupational disease regulation of Social Insurance Institute of Greece (IKA). In a wider sense, however, any worsening of any pre-existing illness due to work conditions is also a work accident
